During the 1st confinement, which began in March 2020, the Brussels government relaxed the notice periods for private tenants and student tenants in order to respond to the difficulties encountered by many of them.

In fact, these tenants, whose notice was running or was expiring, could no longer make visits to find new accommodation, or move into it. They could not therefore honor their commitments initially made.

It is therefore logical that the Brussels government had decided to suspend the notice period as long as the containment measures were in force. The tenant nevertheless remained liable to pay the rent for the dwelling he occupied.

On the student side, they faced difficult and unprecedented situations. The suspension of their classes made some people want to go home. And the temporary stopping of their student job inevitably caused problems in meeting the rent payment of their accommodation.

This is why, in the context of a student lease or a short-term lease, linked to student accommodation, the government had granted a reduction in the notice period of two months to only one, the remaining tenant. still owed that month's rent.

In other words, due to the difficulty of finding new accommodation and the impossibility of moving, Brussels tenants whose lease was about to expire had the possibility of increasing their notice period, while students who wished could leave their accommodation more quickly.

The notice periods began to run normally the day after the publication in the Moniteur of the government order indicating the end of the lockdown.

This is not the case with the 2nd lockdown which took effect on November 2.

Indeed, the Concertation Committee decided to proceed with less strict confinement.

Brokers and managers must work in closed offices. On the other hand, inventory of fixtures and removals are by no means prohibited by ministerial decree. As for visits, they are authorized as long as the property is empty and that they are done without a real estate agent, owner or tenant in the premises. Real estate agencies can therefore continue their activity at a very reduced pace.

These measures much less restrictive than those of the 1st containment explain why the government has not relaxed the rules of notice during this 2nd wave.
